BARTENDER SERVICES
Luxcraft Manila will be responsible for providing the necessary equipment, ingredients, and beverages, as well as the bartending services (hereinafter referred to as the "Services") as agreed upon with the Client. Luxcraft Manila will ensure a high standard of service throughout the occasion. Luxcraft agrees to adhere to the appropriate dress code. Luxcraft Manila will set up the necessary equipment at the designated location, including bar tools and glassware in a timely manner. They will be responsible for the teardown and pickup of all equipment when the event ends.
CLIENT RESPONSIBILITIES
The Client shall ensure that Luxcraft Manila has timely access to the event venue to set up the mobile bar and related equipment. The Client must ensure that the venue is equipped with the necessary facilities, such as power outlets, which are required for the mobile bar’s operation. The Client shall also ensure compliance with any venue-specific regulations and policies. The Client should ensure that required space will be given to the mobile bar.
PAYMENT AND FEES
The Client agrees to pay Luxcraft Manila the fees stated in the client intake form. The deposit for the Services is due upon signing this agreement, and 50% of the remaining balance should be settled 30
days before the event and full payment may be paid on the event date or a day before. In the event of non-payment, Luxcraft reserves the right to withhold the Services. The Client is responsible for any additional costs incurred while the Services are provided, including but not limited to transportation, special requests, or other unforeseen expenses required for optimal operation of the mobile bar.
OVERTIME FEES
The agreed-upon service period is outlined in the client intake form, which specifies the start and end times for the provision of the Services. Any services rendered beyond the agreed-upon period shall be considered overtime and will be subject to additional charges. The Client agrees to pay any overtime charges at an hourly rate of Php 5,000/hour. If the Client anticipates the need for overtime services, Luxcraft Manila must be notified as early as possible. Overtime charges should be paid within 3 days after receiving the invoice for these services.
CANCELLATION OF SERVICES
Rescheduling of the Services is subject to the Luxcraft Manila’s availability. To cancel or reschedule the Services without incurring a fee, the Client is required to provide written notice at least 30 days prior to event date. If the Client chooses to reschedule after this period, a fee of 5,000 may be charged. If a cancellation is made after this period, the Client shall be responsible for paying the full contract amount as stated in the client intake form. The Mobile Bartender Company reserves the right to cancel the agreement if, for reasons beyond their control, they are unable to fulfill the contracted services. In such cases, the Luxcraft Manila will make reasonable efforts to provide notice to the Client as soon as possible and issue a refund minus any costs already incurred.
CONFIDENTIALITY
Luxcraft Manila shall keep all of the Client’s information (e.g., contact information) strictly confidential and agree not to disclose it to any third parties without the Client’s explicit written consent.
LIABILITY
The Client agrees to indemnify and hold harmless the Luxcraft Manila and its agents, employees, and subcontractors from and against any and all claims, injuries, liabilities, damages, and costs, including reasonable attorney's fees, arising in connection with the event, except in cases of gross negligence or willful misconduct.
PHOTO RELEASE
I hereby grant Luxcraft Manila permission to use my likeness in a photograph, video, or other digital media (“photo”) in any and all of its publications, social media accounts, including web-based publications, without payment or other consideration.
I understand and agree that all photos will become the property of Luxcraft Manila and will not be returned. I hereby irrevocably authorize Luxcraft Manila to edit, alter, copy, exhibit, publish, or distribute these photos for any lawful purpose. In addition, I waive any right to inspect or approve the finished product wherein my likeness appears. Additionally, I waive any right to royalties or other compensation arising or related to the use of the photo.
I hereby hold harmless, release, and forever discharge Luxcraft Manila from all claims, demands, and causes of action which I, my heirs, representatives, executors, administrators, or any other persons acting on my behalf or on behalf of my estate have or may have by reason of this authorization.

ENTIRE AGREEMENT
This contract constitutes the entire agreement regarding the Services and supersedes all prior discussions, understandings, and agreements, both written and verbal.
FORCE MAJEURE
Neither party shall be held accountable for unforeseeable circumstances or events beyond their control, including acts of nature, government actions, war, epidemics, or other events hindering the contract’s
performance. The affected party must promptly notify the other party and make reasonable efforts to mitigate the event's effects.
SEVERABILITY
If any provision of this Agreement is found to be invalid, illegal, or unenforceable under applicable law, the invalidity, illegality, or unenforceability of such provision shall not affect the validity or enforceability of the remaining provisions of this Agreement.
No modification, amendment, or alteration of this Agreement shall be binding unless it is made in writing and duly executed by both parties. By signing below, both parties acknowledge and agree to the terms and conditions stated in this Agreement.
